This Privacy Policy explains how elements gmbh ("we", "us", "our") collects, uses, stores, and protects the personal data of visitors to timeout-racing.com (the "Website") and users of the services offered under the TimeOut Racing brand (the "Services").

 

We comply with the Swiss Federal Act on Data Protection (revFADP / nDSG) and, where applicable to visitors located in the European Economic Area, the EU General Data Protection Regulation (GDPR).

  • Analysing Website traffic with your consent — Consent (GDPR Art. 6(1)(a)) and explicit consent under revFADP.

  • Complying with legal retention and tax obligations — Legal obligation (GDPR Art. 6(1)(c)).

  • Defending against legal claims — Legitimate interest (GDPR Art. 6(1)(f)).

5.1 Wix.com (hosting and site functionality)

The Website is hosted on the Wix platform operated by Wix.com Ltd (Israel, with EU subsidiary Wix.com Ireland). Wix processes technical data necessary to deliver and secure the Website, including IP addresses, browser fingerprints, and session cookies. Wix acts as our data processor under a Data Processing Agreement.

Wix services used on this Website include Wix Forms (which processes contact form submissions and stores them in our Wix dashboard for our retrieval), Wix Chat (which enables real-time chat between visitors and our team; chat transcripts are stored in our Wix dashboard), Wix Blog (which publishes blog content and, if comments are enabled, stores comment data), Wix Events (which stores registration data if you sign up for an event), and Wix Video (which provides embedded video playback and may set cookies for player state).


5.2 Google Analytics 4 (traffic analytics)

We use Google Analytics 4 (property ID: G-1ED7QTBXKW) operated by Google LLC (USA) and Google Ireland Limited to understand how visitors use the Website in aggregate. IP addresses are anonymised before storage. Analytics is only loaded after your consent through the cookie banner.

The data shared with Google Analytics (with your consent) includes a truncated IP address, your device, browser and screen size, the pages you visit and interaction events, an approximate geographic location at country or city level, and an anonymous client identifier. We do not share personally identifiable information such as your name or email address with Google Analytics.

 

5.3 Sentry (error monitoring)

We use Sentry (Functional Software Inc., USA) embedded by Wix to monitor JavaScript errors on the Website. When an error occurs, Sentry receives the error message, stack trace, browser type, page URL, and a truncated IP address. This processing is based on our legitimate interest in maintaining a functional and secure Website.

5.4 Social media — outbound links only

The Website contains links to our profiles on Facebook, Instagram, LinkedIn, and YouTube. These are plain hyperlinks, not embedded widgets. No data is transferred to these platforms simply by visiting our Website. When you click such a link and visit the respective platform, the platform's own privacy policy applies.

 

5.5 Search engine verification

We have verified the Website with Google Search Console and Bing Webmaster Tools to monitor search visibility. These services do not process visitor data on our Website beyond standard crawler interactions.

 

5.6 Future services notice

If we add new third-party services that process personal data (for example Google Ads remarketing, newsletter providers, or payment processors), we will update this Privacy Policy and, where required, request your renewed consent before activation.

6. Data Sharing and Disclosure

We share personal data only with our data processors (Wix.com Ltd, Google LLC, Functional Software Inc.) under contracts that bind them to confidentiality and security obligations; with authorities when required by Swiss or EU law (for example tax authorities or law enforcement upon valid legal request); and with our professional advisors (lawyers, accountants) who are bound by professional confidentiality.

We do not sell, rent, or trade personal data. We do not transfer your data for the marketing purposes of unrelated third parties.

 

7. International Data Transfers

Some of our processors are based outside Switzerland and the EEA.

Google LLC operates from the United States. Adequate protection is ensured via EU-US Data Privacy Framework certification and Standard Contractual Clauses.

Wix.com Ltd operates from Israel. Switzerland and the EU recognise Israel as providing adequate data protection.

Functional Software Inc. (Sentry) operates from the United States. Standard Contractual Clauses are in place.

For any transfer outside Switzerland or the EEA where no adequacy decision exists, we rely on Standard Contractual Clauses approved by the Swiss Federal Data Protection and Information Commissioner (FDPIC) and the European Commission.

 

8. Retention Periods

We retain personal data only as long as necessary for the purposes set out in this Policy.

Contact-form and chat enquiries where no contract is concluded are kept for 12 months from your last contact, then deleted. Contract-related data for clients is retained for 10 years under Swiss commercial law (Code of Obligations).

Tax-relevant records are retained for 10 years under Swiss tax law.

Cookie consent records are retained for 12 months from the date of consent.

Website analytics data in Google Analytics 4 is retained for 14 months (the default GA4 retention period).

Server logs operated by Wix are retained for up to 30 days.

After the retention period expires, data is either deleted or irreversibly anonymised.

This includes TLS encryption for all data transmitted to and from the Website, access controls within our Wix dashboard, regular security updates, and contractual security obligations imposed on our processors.

No method of internet transmission or electronic storage is 100% secure. In the unlikely event of a personal data breach affecting your rights, we will notify the relevant supervisory authority and you in accordance with applicable law.

11. Children

Our Services are not directed to children under 16, and we do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us so we can delete it.

We do not use your personal data for automated decision-making or profiling that produces legal effects concerning you.

We may update this Privacy Policy from time to time to reflect changes in our services, legal requirements, or industry practices.
